Welcome to IgorBox.com (“Website”), operated by Rising Orchards LLC (“Company,” “we,” “our,” “us”).
These Terms and Conditions (“Terms”) govern your access to and use of our website, products, services, and any associated hardware or software (collectively, “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Scope of Services
IgorBox provides:
- Software: Multi-tenant SaaS platform, proprietary and open-source software and firmware.
- Hardware: IoT devices, microcontroller-based controllers, and accessories.
- Support & Documentation: Knowledge base, community forums, and optional paid technical support.
These Terms apply to all editions, versions, and deployments of IgorBox software and hardware, whether hosted by us, self-hosted by you, or installed on your devices.
2. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use our Services. By using our Services, you represent that you meet these requirements.
3. Accounts
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Licensing and Intellectual Property
- Open-Source Software: Certain IgorBox software is released under open-source licenses (e.g., MIT, GPL). Those licenses govern your rights for that software and are bundled with the open-source code.
- Proprietary Software: Licensed under a paid, proprietary license. You may not copy, modify, decompile, reverse-engineer, or redistribute without written consent.
- Hardware Designs: IgorBox hardware schematics, PCB layouts, and firmware are proprietary unless otherwise noted.
- All trademarks, logos, and branding are property of Rising Orchards LLC.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful or prohibited purpose.
- Interfere with or disrupt the Services or associated networks.
- Circumvent licensing restrictions or security measures.
- Deploy IgorBox devices or software in safety-critical applications without our written approval.
5.1 Non-Safety-Critical Use
The products are not designed, manufactured, or intended for use in:
- Life safety systems
- Emergency systems
- Medical devices
- Critical infrastructure
- Any application where failure could result in death, personal injury, or severe property damage
You agree not to use the products in such applications without prior written approval from Rising Orchards, LLC.
6. Hardware and Firmware Usage
6.1 Secure Boot – IgorBox hardware is designed with secure boot technology to ensure only digitally signed, official IgorBox firmware can run on the device.
6.2 Official Firmware Requirement – You may only operate IgorBox hardware with firmware provided and signed by IgorBox. Installing or attempting to install unauthorized firmware, bypass secure boot, or modify bootloaders is prohibited.
6.3 Warranty Impact – Any tampering, modification, or use of non-IgorBox firmware may void your warranty, terminate associated software licenses, and may be a violation of applicable intellectual property laws.
6.5 Misuse and Unauthorized Modifications – Any of the following will void all warranties and may limit or eliminate liability:
- Use outside of documented specifications
- Unauthorized modifications or repairs
- Improper environmental conditions (temperature, humidity, dust, vibration, etc.)
- Integration with incompatible or unsafe systems
Rising Orchards shall not be responsible for any resulting damage, injury, or loss.
6.4 Firmware Updates – Firmware updates are distributed by IgorBox via secure, authenticated channels. You are responsible for installing updates when recommended to maintain device security and performance.
7. AI Usage and Data
We may incorporate artificial intelligence (AI) technologies into our Services for purposes such as analytics, automation, and feature enhancement.
We may also collect and process anonymized or aggregated data derived from your use of the Services to:
- Improve system performance.
- Develop and train AI models.
- Enhance product features and security.
No personally identifiable information (PII) will be used for model training without your explicit consent.
7A. SMS / Text Messaging Terms
By enabling SMS Notifications in your IgorBox account, you consent to receive recurring automated text messages from Rising Orchards LLC (IgorBox) about your account, device telemetry, orders, and setup status. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; after you send STOP we will send one confirmation message and no further texts. Reply HELP for help, or contact help@igorbox.com. Carriers are not liable for delayed or undelivered messages. Mobile opt-in information is not shared with third parties except the messaging provider that delivers these texts on our behalf.
8. Orders, Pricing, and Payment
- Prices are subject to change without notice.
- Payment must be received before shipment or license activation.
- Enterprise subscriptions renew according to the terms in your order confirmation.
9. Shipping and Returns
- Hardware is shipped to the address provided at checkout.
- Returns and refunds follow our Return Policy (https://store.igorbox.com/return-policy)
10. Installation, Wiring, and Compliance Responsibility
You are solely responsible for the proper installation, configuration, and use of all hardware products. This includes, but is not limited to:
- All electrical wiring and connections
- Compliance with applicable local, state, and national electrical codes and regulations
- Use of appropriate power sources, fusing, and safety mechanisms
- Ensuring that installation is performed by qualified personnel where required
Rising Orchards, LLC (d/b/a IgorBox) is not responsible for any damage, injury, or loss resulting from improper installation, wiring, configuration, or use of the products.
11. Assumption of Risk
You acknowledge that the products may interface with electrical systems, mechanical systems, and other equipment that carry inherent risks, including but not limited to property damage, equipment failure, or personal injury.
By using the products, you assume all risks associated with such use, except to the extent caused directly by a proven defect in the product itself.
12. Warranties and Disclaimers
- Hardware is warranted against manufacturing defects for 12 months from delivery.
- Software, firmware, and cloud-based services are provided ”as is” and ”as available” without warranties of any kind.
- We do not guarantee uninterrupted operation, error-free performance, or compatibility with all systems.
- To the maximum extent permitted by law, Rising Orchards disclaims all implied warranties for software and services, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
- Hardware components are subject to the limited warranty explicitly provided in our Limited Hardware Warranty.
13. Exclusive Remedy
To the maximum extent permitted by law, your sole and exclusive remedy for any claim arising out of or relating to the products or services shall be limited to one of the following, at Rising Orchards' sole discretion:
- Repair of the defective product
- Replacement of the defective product
- Refund of the amount actually paid for the product or service
No other remedies, damages, or claims shall be available.
14. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data, or business opportunity.
- Our maximum total liability will not exceed the amount paid by you for the specific product or service giving rise to the claim.
- Any limitation of liability applies on a per-claim basis and regardless of the number of claims or legal theories asserted.
15. Indemnification
You agree to indemnify and hold harmless Rising Orchards LLC from claims, damages, and expenses arising from your use of the Services or violation of these Terms.
16. Termination
We may suspend or terminate your access if you violate these Terms. Upon termination, your rights under any license will immediately end.
17. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
18. Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your rights.
- Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, rather than in court, except that you and we may assert claims in small claims court if they qualify.
- The Federal Arbitration Act and federal arbitration law apply to this agreement. Arbitration will be administered by a reputable arbitration provider under its applicable rules. The venue will be Florida, USA, unless otherwise required by law. Judgment on the award may be entered in any court with jurisdiction.
- Class and representative actions are not permitted. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
- Opt-Out: You may opt out of arbitration within 30 days of first accepting these Terms by sending a written notice to help@igorbox.com with subject line “Arbitration Opt-Out,” including your name and the email address associated with your account.
19. Export Controls and Sanctions
You agree to comply with all applicable export control and sanctions laws and regulations, including those of the United States and other relevant jurisdictions. You will not export, re-export, or transfer the Services or related technical data to any prohibited countries, entities, or end users, or for any prohibited end uses.
20. Changes to Terms
We may update these Terms from time to time. Changes will be posted on our Website, and your continued use of the Services indicates acceptance of the updated Terms.
